The Civil Summons must be printed on the front and back of one page.
1. Fill in the County (if you are filing in Wake County, write Wake in the
blank before County at the top of the page).
2. On the top right side of the page, under the section In The General Court
of Justice, place an X in the box in front of District.
3. In the next section on the left side of the page, just below where you filled
in the name of the county, write the Name of Plaintiff (you, the person filing
the COMPLAINT and CIVIL SUMMONS). Make sure the name looks exactly
the same as the name of the Plaintiff on the COMPLAINT. Below that write
the Plaintiff's (your) correct address.
4. In the left column below the word VERSUS, write the Defendant's
(your spouse's) name as it appears on the COMPLAINT.
5. In the left column, in the section marked To Each Of the Defendant(s)
Named Below:, write the full name and address of the Defendant (your
spouse, the person who will receive the CIVIL SUMMONS). This information
must be correct in order for your spouse to be served with the CIVIL
SUMMONS and COMPLAINT.
6. Below the section marked, A Civil Action Has Been Commenced Against
You!, in the section in the left column marked Name and Address of Plaintiff's
Attorney (If None, Address of Plaintiff) write in the correct name and address
of the Plaintiff (you, the person filing the CIVIL SUMMONS).
All of the other information on the front and back of the CIVIL SUMMONS will be
filled out by the clerk of court when you file the forms.
